Sometimes a person looking for an installer contacts us, or uses our directory, and we pass that enquiry on. These terms say exactly what we do, what we do not do, and where our involvement stops. They apply both to the person making the enquiry and to the installer who receives it.
Part A — For people making an enquiry
A1. What we do
We pass your enquiry, and the contact details you give us for that purpose, to one or more independent installers in your area who hold an Academy status. That is the whole of what we do.
A2. What we do not do
We do not choose an installer for you, recommend one, rank one above another for a reason we will not state, or select one on your behalf. We do not quote for the work, price it, negotiate it, schedule it, project-manage it, supervise it, inspect it, take payment for it, hold your money, or take any commission, referral fee or other payment from the installer for passing the enquiry on. No money passes between us and an installer in either direction in connection with an enquiry.
A3. How enquiries are passed on
A3.1 Enquiries are passed on by proximity to the location in the enquiry, the Academy status held, and indicated availability. Where more than one installer fits, enquiries are distributed among them on a rotating basis. That is the complete basis, and it is stated on the surface where you make the enquiry.
A3.2 No installer can pay for enquiries, for more enquiries, for earlier enquiries or for a priority position. There is no paid tier, lead subscription or premium routing of any kind.
A3.3 Being passed your enquiry does not mean an installer is available, will respond, will quote, or will take the job.
A4. Your contract is with the installer
Installers are independent businesses — not our employees, agents, representatives, franchisees, partners or subcontractors. If you engage one, you contract with them directly, on their terms and at their price. We are not a party to that contract and we do not guarantee their performance of it. A dispute about the work is between you and the installer.
A5. What an Academy status does and does not tell you
Please read the Academy Tier Definitions and Criteria before you rely on a status. In short: Verified means we reviewed documentation for two or more of that installer's completed installations against our published installation instructions and found, on that documentation, that they conformed. It is not an endorsement of their business, a guarantee of their future work, or confirmation of their licensing or insurance. Ask any installer for their licence details and their insurance certificate, and satisfy yourself independently.
A6. Your information
We use your enquiry details only to pass the enquiry to installers and to follow up on the enquiry itself. We tell you, at the point you make the enquiry, that this is what will happen. See the Academy Learner Privacy Notice and our general Privacy Notice for how we handle personal information, including how to ask us to stop.
A7. Product warranty is governed by its own terms
Any product warranty, and the conditions on which it applies, is governed by the applicable QwickBuild warranty terms. Whether we passed your enquiry to a particular installer does not by itself determine or guarantee any warranty outcome.
Part B — For installers receiving an enquiry
B1. What you receive, and what it is not
B1.1 An enquiry is information about someone who is looking for an installer. It is not an offer of work, an instruction, a job we have booked, a promise of any volume or value of enquiries, an appointment, an authorisation to act for us, a territory, or an exclusivity.
B1.2 You are free to decline any enquiry, for any reason, with no consequence for your Academy status.
B1.3 You are not required to respond within any time, to price in any way, to use any form of quotation, to follow any sales method, or to report the outcome to us. We do not set, recommend, cap or influence what you charge your customer. If we ever ask you whether an enquiry converted, answering is voluntary and has no bearing on your status or on future enquiries.
B2. There is no charge
You pay nothing to receive enquiries — no fee, subscription, commission, success fee, levy or contribution of any kind, and none may be introduced as a condition of receiving them. See section 7 of the Participation Terms.
B3. Your obligations
B3.1 Deal with the enquirer honestly and promptly, and treat their information confidentially. Use it only to respond to that enquiry, do not add it to a marketing list without their agreement, and do not pass it on to anyone else.
B3.2 Do not tell the enquirer that we sent you, recommended you, appointed you, approved you, vetted you, guarantee your work, or that we are involved in the job. You may say accurately that you hold your Academy status and that the enquiry reached you through Outdure.
B3.3 Contract with the customer directly, in your own name, on your own terms, at your own price. Do not use our name, our forms or our marks as the contracting party, and do not accept payment in our name.
B3.4 Do not say or imply that using you changes the customer's warranty rights.
B4. Where our involvement ends
Once the enquiry has been passed to you, we step out. We do not manage the relationship, hold the money, set expectations about the work or resolve a dispute between you and the customer. If a customer contacts us about your work, we will tell them that the contract is with you and pass their concern to you. Where what they tell us raises a ground under the Academy Assessment and Revocation Policy, we consider it under that policy and record what we did — including a decision that no action is needed and why.
Governing law and disputes are set out in the Academy Jurisdiction Overlays, which apply to this document as if set out in it in full. Nothing in these terms limits a right you have under the law of your own country that cannot lawfully be excluded, including a consumer guarantee.
